DIY Buy Advisory
Terms of Engagement.

Please read these terms before you join. They set out what DIY Buy includes, what it doesn't, what you pay and how the service ends. Your engagement schedule, which we send before you pay, confirms your start date, billing day and minimum-term end date. If the schedule and these terms conflict, the schedule applies.

"We", "us" and "our" means Taylor Davies Property Group Pty Ltd, trading as Davies Buyers Agents. "You" means the person or people named in your engagement schedule.

The service

DIY Buy Advisory is a remote buyer consultancy. You search for property and inspect it yourself. We advise you along the way. The service includes:

  • Strategy session. One 60-minute session to set your budget, target areas, priorities and acceptable compromises.
  • Buyer Plan. A personalised Buyer Plan and buy box, which we aim to deliver within two business days of your strategy session.
  • Resource pack. An inspection comparison sheet, a due-diligence checklist and a professionals directory.
  • Private chat. Direct messaging with your consultant on WhatsApp.
  • Deal Room. Two scheduled group Q&A sessions each week with other DIY Buy members.
  • Weekly property review. One written desktop review per service week of a property you nominate.

A service week runs from your billing day to the day before your next billing day. One property review is available each service week. Unused reviews don't carry over to later weeks.

What the service doesn't include

Under DIY Buy we don't:

  • search for properties or inspect them on your behalf
  • contact selling agents on your behalf
  • prepare or submit offers, negotiate, or bid at auction
  • provide formal valuations, or legal, tax, financial, building, pest, engineering or survey advice.

You remain responsible for searching, inspecting, dealing with selling agents and making every purchase decision.

Property reviews are limited desktop assessments. They are based on the listing, the information you give us and the public sources available to us at the time. Each review shows the sources we used and what we couldn't confirm. A review is not a substitute for a building and pest inspection, legal review of the contract, a survey or a formal valuation. Arrange those independently before you commit to a purchase.

We can't guarantee that you will find a property, buy below a particular price, get finance approval or achieve any investment outcome.

If you want us to act for you, we offer Property Pursuit (negotiation on one property) and Full Service (search through to settlement). Each is engaged separately under its own agreement and appointment.

Access and response times

Private chat. Message us at any time. We reply within one business day, Monday to Friday, excluding Queensland public holidays.

Property reviews. Submit the listing, the price guide, your inspection notes and your questions. We confirm the delivery time when we receive a complete submission. Review timing is separate from the chat response time.

Deadlines. Tell us about auction dates, offer deadlines and contract dates as early as possible. We prioritise where we can, but we can't guarantee turnaround against a deadline that is set at short notice.

Calls. We can arrange a call when it will be more useful than messages. The service does not include a standing weekly call.

Deal Room. Session times are published in advance. We notify active clients of holiday closures and schedule changes.

Your responsibilities

You agree to:

  • give us accurate information and any documents relevant to your search
  • tell us promptly about deadlines, changes to your brief and changes to your circumstances, including your finance
  • arrange independent specialist checks before any purchase
  • inspect properties and deal with selling agents yourself
  • keep property addresses, finances and other personal or sensitive details in private chat, not the Deal Room
  • respect other members, and not share their information outside the Deal Room.

We may remove a member from the Deal Room for abusive conduct or for sharing other members' confidential information. If that happens, your private chat and property reviews continue.

Fees and payment

Price. $275 inc. GST per week ($250 + $25 GST).

Minimum term. 12 weeks, totalling $3,300 inc. GST.

Billing. Your first payment is charged on your start date. Later payments are charged automatically to your card on the same weekday each week. Payments are processed by Stripe.

Tax invoices. We issue a tax invoice for each payment.

After 12 weeks. The service ends at the end of week 12 unless you tell us you want to continue. We'll contact you before week 12 ends to ask. If you agree to continue, we bill you weekly at the price we confirm with you. You can then cancel at any time, with effect from the end of the current paid week. We never automatically start a new fixed term.

Failed payments. If a payment fails, we'll tell you and give you 5 business days to update your payment method. We may pause the service after that. We don't charge for any period in which the service is paused.

Cancellation and early exit

You can ask to end the service at any time by messaging us in private chat or emailing taylor@daviesbuyersagents.com.au. We'll confirm your end date and any amount owing in writing before anything further is charged.

Cancelling within the 12-week minimum. Your access ends at the end of your current paid service week, and weekly charges stop. An early-exit fee then applies. The fee is the lower of:

  • the weekly payments remaining in your 12-week minimum, or
  • $1,100 inc. GST (4 weeks).

This fee reflects the setup work at the start of the service: the strategy session, the Buyer Plan and the resource pack.

No early-exit fee applies if:

  • You buy a property. You sign a contract that becomes unconditional during your minimum term. Tell us, and billing stops at the end of the service week in which you told us.
  • You upgrade to Full Service. See section 07.
  • We don't deliver the service as described and don't fix the problem within a reasonable time after you tell us.
  • Hardship. Your circumstances change significantly, for example through a loss of income, a failed finance approval or a serious illness. You'll need to tell us, and we'll consider the request fairly.

Paid weeks. Weeks you have already paid for cover services already made available to you. They are not refunded, except where section 08 or the law requires a refund.

If we end the service. We'll give you at least 7 days' written notice. We won't charge for any period after the service ends, we'll refund anything prepaid for weeks we don't supply, and no early-exit fee applies. We may end the service immediately, with an early-exit fee payable, only if you seriously breach these terms. Examples are abusive conduct towards us or other members, or providing materially false information.

Upgrading to Full Service

If you engage our Full Service while you are an active DIY Buy client, we credit the DIY Buy payments we've received towards the Full Service engagement fee.

  • The credit equals your DIY Buy payments received and not refunded or reversed, up to the amount of the Full Service engagement fee.
  • Credits are calculated including GST.
  • The credit reduces the engagement fee only. It doesn't reduce any other Full Service fee, and it is applied once.
  • Any amount above the engagement fee isn't refunded, transferred, or credited to another service or person.
  • DIY Buy billing stops on your Full Service start date, including any remaining weeks of your minimum term. Your Full Service engagement documents set out the credit amount and how a partly used week is treated.
  • Full Service begins only once you have signed its separate agreement and appointment.
  • The credit doesn't apply to Property Pursuit.

Your rights under Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those rights, or any other right that the law says can't be excluded.

If we fail to meet a consumer guarantee and the failure isn't major, we may choose to supply the affected service again or refund what you paid for it, where the law allows us to limit our liability that way. If the failure is major, you have the remedies the Australian Consumer Law gives you.

Your materials and ours

Your Buyer Plan, property reviews and resource pack are for your personal use in your own purchase. Please don't republish or resell them. Anything you share with us remains yours.

Privacy

We collect your name, contact details, search details, and the finance information you choose to share with us. We use it to deliver the service, manage your engagement and meet our legal obligations.

  • Payment. Stripe processes your payments. We don't see or store your full card details.
  • Storage. Some of our providers, including Stripe, WhatsApp (Meta) and our business software, may store data outside Australia.
  • Sharing. We only share your information with another professional after you've given permission.
  • Deal Room. Anything you post in the Deal Room is visible to other active members.
  • Marketing. We send you marketing messages only if you opt in separately. You can unsubscribe at any time.

Referrals and relationships

We may recommend solicitors, finance brokers, building inspectors or other professionals. If we have a relationship with one of them or receive a referral payment, we'll tell you before we introduce you. Whether you use anyone we recommend is always your choice.

Appointments required by law

If Queensland law or the law of the state where the property is located requires a signed appointment or agency agreement for any activity, we'll complete it with you before that activity begins.

DIY Buy is currently available for purchases in [QUEENSLAND / LIST STATES] only.

Complaints

If something isn't right, contact Taylor at taylor@daviesbuyersagents.com.au or on 0406 629 210. We'll acknowledge your complaint within 2 business days and aim to resolve it within 10 business days.

If we can't resolve it, you can contact the Queensland Office of Fair Trading.

Changes to these terms

We may update these terms and will give active clients at least 14 days' notice of any change. A change that increases your price or reduces your service during your 12-week minimum doesn't apply to you until that term ends, unless you agree to it. The version you accepted is recorded in your engagement schedule.

Governing law

These terms are governed by the laws of Queensland, Australia.

Acknowledgement

"I have read and accept the DIY Buy terms (Version 1.1, [DATE]). I understand the charge is $275 inc. GST per week for a 12-week minimum, totalling $3,300 inc. GST. I have read the cancellation, early-exit and continuation terms."
